PLACING AN ORDER


If you would like to place an order, you can do so using our automated shopping cart system. Our on-line system allows for payment by credit card, PayPal, check, money order, and cash. However, if you would prefer to place an order by mail or fax without taking advantage of our automated system, you can use our non-automated printable order form.

ORDER MINIMUMS

There is a current order minimum of $9.99 on our standard website. All orders must meet a minimum merchandise total of $9.99 in order to proceed to the checkout process. The Special Volume Discount Site has a current order minimum of $50.00. There are NO EXCEPTIONS to these minimum requirements.

CREDIT CARDS

By submitting your credit card information through our on-line shopping cart system, you are authorizing Biros Merchandising to charge your credit card in the amount specified. You agree that you are authorized to use the credit card specified for the purchase, and you will take steps so that no accidental chargebacks occur (by ensuring that whoever receives the credit card statement is aware of this purchase). You also understand that "Biros Merchandising" or "BirosMerchandise" will show up on my credit card statement. In the event of a mistaken chargeback you agree to pay a $40 processing fee in addition to the original invoice amount.

You can shop at XpressMart.com with confidence. We have partnered with Authorize.Net, a leading payment gateway since 1996, to offer safe and secure credit card and electronic check transactions for our customers.

The Authorize.Net Payment Gateway manages the complex routing of sensitive customer information through the credit card and electronic check processing networks (see an online payments diagram). The company adheres to strict industry standards for payment processing, including:

CHECK, CASH, OR MONEY ORDER TERMS

All mail orders will be held for two weeks until all payments clear (with the exception of CASH payments). They will then go into our standard shipping schedule. Orders will ship within 5 business days (after payment clears). Orders are filled on a first-come, first-served basis. It is possible that when your order arrives at our facility, all of the items that you've ordered will no longer be in stock. If that is the case, you order will be filled with products that are "in stock", and you will be sent a refund by company check for the remaining balance.

There is a RETURNED CHECK FEE OF $20.00 for all checks that are returned from the bank for ANY REASON. This fee will be in addition to the original total of the order and any bank charges that are incurred. THERE ARE NO EXCEPTIONS.

Some people may think that to hold a check for two weeks is a bit extreme. Unfortunately, there are some really bad people out there and we need to protect ourselves. We have experienced a situation where we deposited a customers check and we were notified 9 days later that the check was returned due to INSUFFICIENT FUNDS. We lost the sale and we were charged a $10.00 fee for our effort. We will, therefore, hold all CHECKS and MONEY ORDERS for two weeks . . . NO EXCEPTIONS.

SPECIALS AND COUPON OFFERS

Failure to enter a COUPON CODE during the checkout process will prevent your discount from being applied for coupon offers. Coupons CANNOT be applied after an order has been paid for, so make sure to enter your code before checking out.

Failure to properly enter a COUPON CODE during the checkout process will generate an error message. If you have difficulty typing in the coupon code, please copy and paste the code from the original email message that was sent to you (as this will eliminate potential typos). Again, coupons CANNOT be applied after an order has been paid for, so make sure to enter your code before checking out.

LIMITATIONS: Coupons are valid through the on-line shopping cart ONLY. A COUPON CODE cannot be used with any other coupon offer. Products offered are subject to availability.

EXPIRATION: COUPON OFFERS are available for a limited time only, and this time period is at the discretion of the management company.

PAYMENT

When ordering via the internet and through our "shopping cart" system, visitors are required to pay by credit card or PayPal. At the time the order is placed, the credit card transaction will be verified, authorized, and completed via a secured server.

However, if you would prefer to place an order by mail, you can use our BY MAIL ORDER Instructions (which still uses our "shopping cart" system.



SHIPPING

DELIVERY CONFIRMATION

All packages that are shipped via U.S. Priority Mail with Delivery Confirmation are considered "successfully delivered" if the U.S. Postal Service reports it as such.

COMBINING SHIPMENTS TO THE SAME ADDRESS

Biros Merchandising, the managing company of www.XpressMart.com, reserves the right to combine shipments of separate orders when they are shipping to the same address. This decision is at the sole discretion of Biros Merchandising, and no refunds will be applied to customers when shipping charges have been paid on separate orders in this case.

SHIPPING/DELIVERY INSURANCE

A Shipping/Delivery Insurance Fee is added to ALL orders based on order value. This Insurance Fee is NOT optional, and is designed to protect all of our valued customers against package damage or loss. If there is a problem with a package, all insurance claims will be handled by Biros Merchandising directly.

Every effort is made by Biros Merchandising to describe the products on our websites. Product descriptions include important details about the product and approximate dimensions along with a photograph of each product. Biros Merchandising makes every effort to supply a true and honest depiction of the product that you will receive. Biros Merchandising is not responsible for errors or typos in any product description, nor are we responsible for minor changes in a product description from one "batch" to another. Slight differences may arrise in size and/or color from one product to another with the same product code.

Biros Merchandising makes every effort to accurately describe and represent its products. Please note, however, that all sizes that are stated are approximate, colors and styles may vary from the photograph that is posted, and we are not responsible for typographical errors of any type.

PRODUCT PRICING

As with other facets of our website, we make every effort to assure accuracy in the description and pricing of our products. We are not, however, responsible for errors or typos in the pricing of items. If an item is found to have a pricing error, a full refund will be made for the product and the pricing error will be corrected.

NONE of the prices on this website are negotiable. Please do not contact us asking to negotiate a different price for an item.

AVAILABILITY

Our site is an automated one. It also tracks our current inventory levels. As items are added to shoppers carts, those products are removed from inventory in the quantites requested. If our entire inventory for a product is added to a cart, an Out of Stock notice will be posted for that product. As shoppers check out of our site, the products are permenantly removed from stock. As shopping carts expire (evey hour), the products from the expired carts are returned to public availability. Every effort is made to keep our inventory counts up to date. If you see a product for sale in our store, that means that our latest inventory counts show that the product is available AT THIS MOMENT. If you place an order, the availiabity of products will be checked at the time of shipment. If there is a problem, you will be contacted or you will be compensated with your shipment.

HARLEY DAVIDSON® LICENSED PRODUCTS

Biros Merchandising (the management company for XpressMart.com, BikerPatches.com, MotorcyclePatches.com) is NOT a Harley Davidson® Licensed dealer nor do we intend to represent ourselves as being affilliated with Harley-Davidson®. The products on our sites are purchased by Biros Merchandising from various sources throughout the United States. When a product is noted as being an "Officially Licensed Product of the Harley Davidson® Motor Company", it means that the product is properly labeled as such. For patches, the back of each patch is clearly marked with the "officially licensed" logo. For pins and other items, the "officially licensed" logo is displayed in some location on the product.

CUSTOM PRODUCTS

The custom products offered through our website include descriptions and suggestions of the number of characters to be used for the custom designs. If a custom order is placed that requests more than the suggested number of characters for an embroidery design, the product will still be produced, but the product will have no guarantee regarding quality, readability, or workmanship.

In the case of custom patches, text and twill colors are customizeable in some cases. If you select a non-complimentary or non-readable color combination, your patch will be produced EXACTLY as you ordered it. For instance, if you select a black patch and then choose black text, your patch will be produced this way. In the past, we would automatically change your color choice to white text on a black patch (in this example), but customers have used this "courtesty change" as a reason to complain about an order that was received. We will no longer make "courtesty changes" on your behalf.

In the case of custom ID tags, if you use Characters that are not shown in the list provided, we will substitute the invalid character with a blank space (or will will use our best judgement to produce a readable tag based on the information that you provided).Also in the case of ID TAGS, 15 characters is an absolute limit. If more than 15 characters are supplied, we will either cut off characters or attempt to edit your text to make it fit. THERE ARE NO RETURNS OFFERED WHEN CHANGES ARE MADE ON YOUR BEHALF DUE TO AN ERROR IN THE NUMBER OF CHARACTERS OR IN THE TYPES OF CHARACTERS WHICH ARE ACCEPTABLE.

ORDER CANCELLATIONS / RETURNS / CREDITS

CANCELLATION POLICY

Our on-line shopping cart system is an automated one. At the moment that your order is placed, the details of your order have already been received, your credit card payment has been authorized, and your order is being processed. Due to the speed with which your order will be processed, our on-line store policy prohibits order cancellations once an order is authorized by you (and you were alerted to this right before the final checkout process).

RETURNS

Claims for damaged merchandise must be made through Biros Merchandising, and will only be honored if INSURANCE was purchased at the time of checkout. Contact us if you've received damaged merchandise and we will begin to process your claim through the insurance company. The buyer promises to cooperate fully with Biros Merchandising to process the insurance claim.

NO RETURNS FOR CUSTOM MERCHANDISE, AND NO RETURNS FOR PRODUCTS PURCHASED THROUGH OUR VOLUME DISCOUNT WEBSITE.

Returns for unwanted merchandise must be made within 15 days of receipt (the date of receipt will be based on the Delivery Confirmation date stated by the U.S. Postal Service). Returns after that date will not be accepted. Packages that have been REFUSED, NO ACCEPTED, or returned due to an INCORRECT ADDRESS provided by the buyer, will be handled as a RETURN and will be subject to all applicable return fees.

All returns must be clearly marked on the outside of the package with the RMA # (create an RMA number by adding the prefix of RMA to the order number that is displayed on your packing list). The package must also include a copy of the original packing list clearly marked with the reason for return. THE PACKING LIST AND EXPLANATION MUST BE SIGNED BY THE CUSTOMER.

All returns will be subject to a 35% restocking fee, and shipping (including handling and insurances fees) is not refundable. All returns must be in absolute resaleable condition. This will be determined by the management company upon receipt, and any damage will be deducted from the final credit (see "Credits" below).

CREDITS

Returned purchases will be processed less shipping and handling charges (and less a 35% restocking fee). THERE ARE NO CASH OR CREDIT CARD REFUNDS. Instead, all credits are made in the form of a store credit. This credit can be used by the account holder for any future purchase. Credits not used within 6 months will expire, and the credit value will be absorbed by the management company.

STORE CREDITS

When using a store credit, you may use the amount of the credit for any items found in our on-line store. When calculating the use of your store credit, calculate the total of the items being purchased plus our standard shipping fee to determine your total.

NOTE REGARDING APPLYING PATCHES:

We have thousands of patches in our inventory. These patches originate from hundreds of different manufacturers from all over the world. It is impossible for us to say with any amount of certainty whether an individual patch that we've mailed out is "iron on" or not. Please do not email us asking for us to supply that information . . . because we can't.

There is one thing that we will say without hesitation . . . you are better off having patches sewn on as compared to any other application option. Sewing a patch on is the only true permanent application. If you can't sew the items on yourself, you may want to take your items to any biker rally where there are generally plenty of vendors who charge a small fee to sew any patch onto any garment for you.
